Title VII makes it illegal to alter the terms and conditions of work on account of race, and that includes an action for harassment. I'm not going to go through the test they use for harassment cases, but things employers say can constitute harassment. I've seen dozens of cases where employers using the n word were successfully sued for creating a hostile work environment. Since the law doesn't directly police speech, it doesn't run afoul of the first amendment's protections. If offensive jokes make the working conditions intolerable for minorities, they are illegal under title vii.

Also, as to your second point, it is illegal to intentionally exclude individuals from certain positions because they are black. Even having a stratified workplace like that could subject an employer to liability under disparate impact theory. These are not the good ole days anymore!

oh, i guess Affirmative Action is a violation of title 7 ? Is that not what got Paula trouble in the 1st place ? She mentioned how she liked the wait staff at a restaurant in Tennesee but thought it might be considered inappropriate ?
The person who filed this lawsuit is just looking for a big pay out . Blacks in this City, especially the prominent ones are backing Paula as well as alot of other people . The plantiff can also be asked if she ever used the N-Word, so were dpes that lead ? It kind of cancels it out but it does go against the plantiff's merit .

I, like alot of people here are tired of Paula and wish she would go away . She has gotten a really fat head . I took up for her and her success until she pretty much bought the River St Christmas Parade and that was it for me .

If you want a suit against Paula, you file it against her fot her son's sexual conduct, especially since they took over the restaurant around 2005/6 .

Affirmative action plans that institute quotas can be a violation of Title VII. Those that are meant to remediate past discrimination in that workplace are generally acceptable. For instance, if an employer wants to accept a higher percentage of African-Americans because his place of employment has historically discriminated against them and advancement there is based on seniority, affirmative action is considered acceptable.

I don't think most courts would consider it a bona fide affirmative action plan to have a position exclusively filled by African-Americans in attire to remind people of slavery so they can sell a Southern Plantation theme. So no, I don't really think affirmative action got her in trouble in the first place.

Paula's use of the n word is not going to be an issue as much at trial as her use of the word in the presence of employees. Some employees using that word themselves would not really bear on whether their supervisors maintained a hostile work environment there.

Of course i don't like the broncoa . The bet the falcons in the superbowl in 99 .

The other thing like i said is B/S . If it wasn't, it would have been settled out of court and the case would have a non disclosure added . Although Paula is feeling alot of heat at the moment, it is limited and she is getting alot of support, especially from the black community .

Remember the Jury will be made up of locals from the Savannah Area, not Youtube or CNN .

To me it is just more Paula Deen publicity i have to hear about .

Btw, my best friend's sister worked for Paula for over 10 years and made it to manager . She started when Paula only had at most 10 people working at her restaurant and that number included her and her family . She was canned when the boys took over like most of the long term staff . I know others that have worked there since . With that said, i have some inside knowledge of the workings at the restaurants here .

This just in .... The local Rape Crisis Center and also the local Safe Shelter have come out publicly in support of Paula .

Even if she wins the suit because the plaintiff cannot show that the comments made the workplace objectively and subjectively intolerable for her, she has probably ended her run as a national figure of note. She will probably be relegated to a regional guilty pleasure, similar to those other guilty pleasures some southerners feel nostalgic about. That said, I'm sure those who continue to go there won't feel they still have to whisper when they order the confederate bean soup.
