Doesn't matter. You don't need a copyright notice to maintain copyright on a piece of art or a document. At best it's a courtesy to the reader.

my point is, until the actually put the copyright notice up most people were ignorant.

i honestly have no problem with them protecting their intellectual property, i know they have the right to do so.

i just have a problem about how they behaved when they decided to do something about it

Martin - the pics you questioned are by Christian Zanier...as mentioned, from Banana Games. I've seen that, and his also excellent Honeylickers Sorority and Tranny Trish & Honey, on a host of free sites. Also, read a backgrounder by him that didn't mention any restrictions.
