In the USA, the prudishness is off the charts. A lot of female teachers get fired not for doing porn but because they had photos in bikinis.

Probably every employee handbook has written in it somewhere "your employment with xyz company' is a privilege -- not a right."

In the US you can be fired for nothing.

I think it's a legal and civil rights issue whose time has come.
But it will take someone with the notoriety and financial resources to fight it in the courts.
Secondly , it's an insight into the current puritanical double standards in American society.

As to this being a new legal frontier, well, I guess my argument would be the same as it would be regarding any other type of discrimination tort: just go ahead and try proving it. It's incredibly difficult.

She announced her comeback and put out some work for Brazzers. If its in the past I hate to see stuff like that but if she is still filming sex scenes then I take no issue with her job firing her for being a current porn star.

She had retired; they fired her because of her PAST as a porn star. She wasn't doing it concurrently.

States might pass laws that make these kinds of restrictions illegal, but the federal government doesn't offer protection for this sort of arbitrary exercise of discretion. With the exception of FLSA, OSHA, Title VII, ADA, the ADEA, section 1981, and the NLRA, all employment is at-will;. It would be more just if a "for cause" standard were implied into all contracts, but the Republicans might be right for once in arguing this would lead to endless litigation. And perhaps employers deserve to have some prerogative as to the personality traits and reputation of who they hire and retain.

Employers can fire you for no reason at all. But that's somewhat deceptive because there is no such thing as making a decision for no reason. What that means is an exercise of discretion on the basis of an irrelevant factor. If it's an excuse for prohibited types of discrimination (race, sex, national origin, age, religion, disability, or retaliation), they can still be sued for it. Success depends on the type and amount of proof.

A firing like this though might actually be a type of sex discrimination, if it's likely that a male pornstar would not have been fired. Enforcing "standards of decency" that only women have to meet is sex discrimination, though tough to prove.
