The NBPP is a pack of despicable assholes bound together by rage and racial hatred. They aren't any better than the KKK except they'll never be as effective as the KKK once was.
Unfortunately (or fortunately if you're a lover of freedom) being a despicable asshole who espouses extreme, racially charged political views is not a prosecutable offense. However, intimidating voters away from the polls on election day is. Two creeps from the NBPP did in fact post themselves (one with a nightstick) outside a polling center on election day in Philadelphia. Here's a clip taken by a "student" reporter.

Unfortunately for any would be prosecutor, the clip doesn't show anyone being intimidated. Their claim is that they are there to prevent blacks from being turned away. But the law is indifferent to their intent. It's how their actions are perceived that counts in law. But not the perception of the judge, or the prosecutor, or the defense attorney, or the average joe citizen who views the clip. What counts in the law is the perception of the victim. What the prosecution needs to make a case is victims who claim they were intimidated away from the polls and are willing to testify to that under examination and cross-examination. In the case against these two guys, there are no victims. The prosecution couldn't produce a single one. There is no case and that is why the Department of Justice dropped the case. Holder made a politically difficult but just decision. The administration in no way shares the views of the NBPP. To attribute their views to Holder or Obama just because they're all black is to allow yourself to be guided by racial stereotyping. Don't you think life would be easier for the administration if it could have prosecuted the case?
This brings us to Christian Adams who is a right-wing activist hired by the Department of Justice under the Bush administration. He's not happy working for an liberal administration. It's time for him to leave. So he hangs on 'til election season and then makes some political hay by claiming to quit over this case. Of course its easy to stir up rage against the New BLACK Panthers and by "association" against Holder and Obama. But that association is based on skin color and an unprosecutable case.

DOJ never tried to prosecute anything. Nobody ever complained. No crime was committed. The other guy (without the stick) was a registered poll watcher & supposed to be there. DOJ sought a civil injungtion on these 2 & 1 other to keep them away from the polls except for voting. They got one on the guy with the stick, but the judge couldn't find a reason to enjoin anyone else.Holder decided not to appeal.
That's all there is. There ain't no more.
