    Spain eases law for transsexuals
    Spain has passed a law allowing transsexuals who have not had a sex change to alter their gender on birth certificates and other documents.

    Only a third of Spain's 8,000 transsexuals opt for surgery to realign their gender.

    Many transsexuals who do not look like the sex on their identification face ridicule, discrimination and unemployment, activists say.

    The governing Socialists say the new law will give them back their dignity.

    Alec Cassanova, of the National Federation for Lesbians, Gays and Transsexuals, told the BBC: "Transsexuals who cannot go through surgery due to health reasons...they will finally be granted this right."

    Due to heightened post 9/11 security there is a greater need for
    US citizenry to have proper identification. This has ramifications
    for the transcommunity and is being addressed.

    Here is the text of the Spanish ruling, with translation:

    "El pleno del Congreso de los Diputados aprobó el jueves la ley que permitirá a los transexuales cambiar en el Registro Civil de nombre y de sexo sin necesidad de someterse a una operación de reasignación genital ni seguir un procedimiento judicial.

    Desde ahora toda persona que solicite este cambio de nombre y sexo deberá acreditar previamente que un psicólogo clínico le ha diagnosticado disforia de género, es decir, un desacuerdo profundo entre el sexo biológico y aquel que la persona siente como propio.

    Entre otros aspectos, el Senado incorporó a la ley la exención de pago de tasas por la reexpedición de documentos y títulos con el nuevo nombre de la persona, además de descartar la necesidad de una sentencia firme por parte de un juez."

    The United States, federal government does not issue brith certificates, states do, thus it really is a local issue. The federal government has passed the "Real ID" act which will require states to verfiy a person's idenity before issuing/renewing drivers licenses. This means one is going to need an offical copy of one's birth certificate or passport before obtaining or renewing a drivers license. The law was passed in response to 9/11, and though states are not happy with the law, have no choice but to comply as the law states the federal government will no longer accept drivers licences from non-compliant states as proof of ID. This would complicate everything from applying for a passport to government benefits like medicaid or welfare.

    By law, transexuals in the United States can obtain a passport that says "female" if they submit a copy of the original certified surgical record showing they have had gender reassigment surgery. Otherwise they must have the gender present on their offical copy birth certificate. This presents a problem as some states do not issue post op transgender persons new birth certificates, but only "ammended" ones or worse yet ones with no gender at all.

    The problem is that one camp says that birth certificates are documents stating the facts as they occured at birth, not what happens later.

    The REAL ID Act of 2005 is Division B of an act of the United States Congress entitled Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005, Pub. L. No. 109-13, 119 Stat. 231 (May 11, 2005)[1]. This controversial legislation is intended to deter terrorism by:


    Establishing the national standards for state-issued driver's licenses and non-driver's identification cards;
    Waiving laws that interfere with construction of physical barriers at the borders;
    Updating and tightening the laws on application for asylum and deportation of aliens for terrorist activity;
    Introducing rules covering "delivery bonds" (rather like bail bonds, but for aliens that have been released pending hearings);
    Funding some reports and pilot projects related to border security; and
    Changing visa limits for temporary workers, nurses, and Australians
