There are few hurdles in successfully making the claim, but I think under my quick review of it (I am not getting paid to look it) he may easily meet all the standards required to seek legal relief. Personally, if I was her I would be calling my attorney and asking what should I do about the photo, because if Tyga's attorney is familiar with certain areas of law I would offer her the opportunity to withdraw and withhold her statements against my client on the condition he would not seek pursue his legal claim under the new law CPC 647(j)(4). I will probably take look at some court cases to see how the courts interpret it, but that's my hunch.
