    Question Seeking Porn Affilate Advice

    Hi everybody!

    I've been thinking about retrying my porn affiliate idea. I was going to only advertise straight porn. I do have a few questions about it. Is it legal to do in all states except for Utah? How often are you required to pay taxes? Is it still a profitable thing to do?

    Um why does it matter what state? Just create a site to feature affiliate content on. At first of year they send you a W9 for your profit so you can pay taxes on it.

    Okay thanks! I thought I would have pay monthly or something. The state does matter. Not every state allows internet porn such as Utah. Certain states require business licenses once you make so much money.

    I have seven affiliate blogs and u can't control if someone in Utah looks at it. And it doesn't matter because ur not producing content. So whatever state ur in has no issue with affiliate. The company produces the content has to obey state laws.

    When you're W9 you have to pay quarterly estimates on the 15th. But of course, you also get to write off legitimate business expenses.

    No u don't. I paid all mine the first of year with taxes. The company sends u the forms of earnings. Like ur job would.

    You're right, I was thinking 1099. But that leads me to another question:

    W9 is for employees...when you're an affiliate of another site, they treat you as an employee?

    That doesn't really make sense because then they'd have to match your SS, pay unemployment insurance and have you on a worker's comp policy (in many states)...and when they 1099 you, you're an expense to them that can be written off.

    http://www.irs.gov/pub/irs-pdf/fw9.pdf that's what they make u fill out. It's for business not employees. At first of yr they send u ur stuff to pay taxes on.

    Right...that form is for them to use in order to legally identify your taxpayer identification number. Employees and independent contractors both fill out that form.

    As an affiliate, you won't be treated as an employee, i.e. they are not going to withhold your tax payments (FICA, etc.), or have you on unemployment and worker's compensation insurance. Whatever they pay you is going to be reported (to the IRS) and you will receive a 1099...that means you are an independent contractor, which for tax purposes is like having a business.

    When income (in this instance, payments) are reported on form 1099, the independent contractor has to make "estimated" payments on the 15th of each quarter. If this was your first year as an independent contractor the IRS may overlook this...but don't worry, they'll remind you.
