How easy is it to get content removed from torrent sites such as isohunt etc?

I found some of my vids on BTjunkie and we DMCA'd them, but nothing happened. They are still there.

Is it because the files are not actually hosted by them, but reside on individuals PC's?

What can be done to remove them?

In the U.S. tens of thousands of people have been dragged into lawsuits by porn studios. All are accused of downloading adult movies on BitTorrent without consent.

In recent months a few of these BitTorrent downloaders started to fight back.

Among other things they claim that porn can’t be copyrighted, because it doesn’t fit the basic principle that copyright should promote “the progress of science” or “useful arts.”

As a result copyright infringement is impossible. But not everyone agrees.

Malibu Media, who are counter sued by “BitTorrent” defendant Jeff Fantalis for millions of dollars,

The First Amendment Lawyers’ Association is getting involved in the case and tell the judge that the claim because it’s discriminatory.

“[The defendant's] position contradicts the Copyright Act and seeks a sweeping, content-based restriction on what genre of works are entitled to copyright protection,” they write in their brief.

“This restriction would, if accepted, not only create a Constitutional problem, but a practical one — fragmenting copyright law on the basis of local community standards.”

A negative ruling on this issue for Malibu Media could be the end of the copyright trolling by adult movie studios.

In addition to the copyright claim, Fantalis also wants millions of dollars in damages for defamation, emotional distress and invasion of privacy.

Definitely a case to watch.

I was curious about the whole Malibu lawsuit...they are seen as nothing more than copyright trolls, not really about the copyright more about the money...

Thank-you Wendy for explaining how it works out. I have been guilty of just watching a tube website and never thinking of how it does financially hurt the performers and all involved.

Tube websites featuring full length clips are evil... here's why

I'm an Independent transsexual porn producer. Any porn I shoot, it costs me. Before I can even hope to sell it, I need to pay for the folks working on it - the person behind the camera and any other talent working with me. I have to pay for a location where we can shoot; I need to pay for any unusual set pieces, props or costumes. Then a few weeks or months later the set goes up and I get sales... or I don't. If I stop getting sales, I'm dead in the water. I won't be able to produce porn anymore. This is all without me drawing any money for my own compensation.

I will gladly put clips out onto the web to drive sales - it's good marketing. But a whole set? That's pissing money. No one wants a full clip on the tube sites... it's always stolen and put there by someone.

I'm not going to give away my numbers, but let's hypothetically say it costs me $500 to produce a set (it doesn't but it should illustrate the point). I put that $500 clip onto a tube website in hopes of driving traffic. If I put that up on a tube for free, I need to get 34 signups at $14.99 (my website's monthly rate) to make back that money. My website converts at 1 in 300 - that means for every 300 folks who visit www.wendysummers.com, 1 signs up. So I need 10,200 folks to see that clip and come to my website to get the 34 signups I need. Looking at tube sites, their top promoted shemale clips are at 100,000 views. There's no way that 10% of the folks who watch a FREE full-length video will join my website.

Maybe 0.5% might, but that's all of 1.7 memberships... no where near the 34 necessary to break even, forget about me covering overhead like credit card fees, hosting fees, etc.

The tube websites make money because they (or surrogates) steal my content and use it to sell things like webcams, sexual enhancers and sex toys.

Every time you use a tube website like that, you are helping to ensure me and many other hard working performers will not be able to make any more porn. I beg you, please stop... I LIKE making porn and would love to do it for a long time coming. But if I can't even breakeven on production costs, I can't do it.

Finally, you mentioned you have to pay the peformers of course. But in the porn industry for relatively competent but not well known performers, do they get royalties for the films? what if a film is a top seller for the year? can the performers come knocking on your door for a share of the profits? Or do they all sign a contract given a one off fee and no royalties? So how do the performers get rich? If they do what you do and become independent producers? I noticed the top straight performers also do their own productions

Hell no we don't budget for it. I need every sale I can get, since more sales lets me invest in larger projects. And I'd love to keep expanding the scope of what I do.

Pretty much everything in the TS industry is flat fee.

Performers typically don't become rich from performing. The people producing the films make the largest share. If performers have money, its typically from ancillary income streams like escorting.

Those of us who self produce do get a larger slice of the pie, but there's trade-offs to it. For example, I'll work less for other companies than other models. Since I'm so strong with my own brand, it's much harder for other companies to monetize content they shoot with me.
