Is it possible for mods or site owners to spy on PMs between members?

I thought that would be an infringement of data protection/confidentiality lawsetc?

A colleague thinks this could have happened to her on a site she was on so left it. Or is the software different on various boards?

the site was a dating/swingers site, which is private members only. Apparently the owner who organises events spies on her members' PMs! that is taking things a bit too far!!
