I have been following this story but haven't been updating this thread...

The facts of the case so far appear to be that the guy in question (DeLee), and the trans girl, and the trans girl's brother were all invited to a party being hosted by a mutual friend.

The trans girl, who was not fully transitioned, was not fulltime, and was NOT at the party in girlmode at al (guymode)- showed up with her brother. The host mentioned to the group of party goers, including DeLee- that the one of the two siblings arriving was really a trans girl.

DeLee, then became angry that such a person would go to the party- got a rifle from the host, ran outside, tracked the two down- and tried to shoot the one who was trans.

The bullet passed through the brother's arm, then entered the girl in the chest- killing her. DeLee then, after firing that single shot- fled to his house in one of the northern suburbs, where he was captured by police.

DeLee and his family have a very long criminal record involving violent crimes, and DeLee himself had literally just gotten out of prison early. Had he "done the time, the first time"- he would still be in jail for his past crimes, as we speak. But the revolving door prison system not only let him out onto the streets early (to save money and room for more inmates) but did so without forcing him to deal with a probation officer or a halfway house.

DeLee was a convicted felon who did not have legal access to a firearm (meaning it was either stolen from the host of the party, or the host of the party knowingly gave his recently released convicted felon friend the firearm illegally).

So far all the Syracuse DA is interested in, is charging DeLee with 2nd degree murder, even though this was premeditated. No word has been mentioned as to whether or not the DA's office even cares how a convicted felon got the firearm in question, and because "gender identity" and "gender expression" are not protected in NYS, this is not a hate crime.

DeLee could be facing the needle anyway however, 2nd degree murder carries a smaller min sentence than 1st degree murder, but in NYS both carry the same maximum penalties AFAIK. However if he gets the min of 2nd degree murder, he could be out back onto the streets not far from now.
