    Default Recreational marijuana is now legal in California.

    California's new law could be the tipping point for the rest of the US.
    However , under Federal law it's still illegal , how will the Trump White House react?

    I think it all depends on how much the Trump administration believes in states' right or if it wants to continue fighting the losing war on drugs. But since he is supposedly considering people like Rudy Giuliani and Chris Christie for attorney general, I think its going to be the latter.

    They'll probably keep it as a scheduled substance and if it's illegal under federal law there actually is no state's rights/10th amendment argument that can be made. The CSA is constitutional (Gonzales v. Raich), even though archaic and stupid. I imagine their version of conservative will be to keep it on the books and not prosecute it. I just can't imagine them wasting the resources.

    The federal government cannot force state police to enforce federal law under something called the anti-commandeering doctrine. They could plausibly enforce it themselves, but I wonder if even they would think it's politically worthwhile to send federal agents into states and carry out federal prosecutions for marijuana offenses.

    Although this is a periodical I've never heard of, their summary is not bad. If the feds want, they can start going after dispensaries.

    Under the controlled substance act currently, the use of medical marijuana is prohibited, but it's possible the feds would have some restraint and not impede on these uses but rather regulate them by mandating how medical marijuana is dispensed.

    But there is no bar for the federal government from attacking dispensaries of recreational marijuana. They would just have to do it with their own federal police, by sending cease and desist letters, then arresting and prosecuting people. Hard to believe they would be that stupid, but we'll see.

    Can't think of a more parochial or idiotic statement on the issue than "good people don't smoke marijuana". This sounds like a cultural judgment rather than any sort of principled policy statement. Even if it were the menace he seems to think it is (and it's not), this would not be how to treat users of a dangerous substance. That it is now used recreationally by millions with mild effects makes this statement even more bizarre. It sounds to me like Jeff Sessions wants to attack marijuana use not because of its alleged harms but because of what he thinks it symbolizes culturally.

    Prediction: Trump wants to be a two term president. He does not begin enforcing CSA in states that have legalized marijuana. Obviously I could be wrong.

    Jeff Sessions is still getting his revenge on all those anti-war, pot smoking hippies he went to school with. Although no one ever gave him a second thought he imagined they were thinking he was uncool. Let it go Jeff, that was decades ago.
