Transsexual loses breast op court battle

A transsexual has lost her High Court battle over an NHS refusal to fund a breast augmentation operation.

The Gender dysphoria sufferer "C", from Reading, Berkshire, not named for legal reasons, wanted West Berkshire PCT to pay £2,300 for the procedure.

She argued that it amounted to a violation of her human rights and unlawful sex discrimination.

But Mr Justice Bean, sitting in London, dismissed her claim for a judicial review.

He said he had found "that there was no duty in either public law or discrimination law to classify all treatment and procedures sought by transsexuals as high priority or core procedures".

The 58-year-old, who has been living as a woman for more than a decade, was described as having been left in physical and psychological "limbo" after her bust failed to develop sufficiently following hormonal treatment.
