Actually kim.com has a new feature that keeps them from being responsible.
The files are encrypted when uploaded so that only you and the people you give the confirmed link to can access it. The files are unreadable by site staff and anyone without the encryption built in to the link. This keeps them from being responsible for content stored and if they want to, they could just bust YOU for it. Their new agreement even states that if they want to they can cooperate with law enforcement without incriminating themselves.
