Transsexual Drug Dealer Spared the Cane

SINGAPORE - A court has spared a Thai transsexual drug dealer from caning because Singaporean law does not allow women to be sentenced to that punishment, a newspaper reported Friday.

Thai prostitute Mongkon Pusuwan, who underwent a sex change from male to female a decade ago, was instead sentenced on Wednesday to six years in jail after a medical report concluded that she was a woman, The Straits Times reported.

District Judge Bala Reddy handed down the sentence after the long-haired Mongkon, 37, pleaded guilty to charges including trafficking in cocaine and tablets containing ketamine, the report said.

The amount of drugs in her possession was too small for her to qualify for Singapore's mandatory death penalty for some drug cases.

Mongkon, whose passport identified her as a male, was arrested in December.

Men who commit similar crimes can be sentenced to caning. Offenders are strapped to a wooden frame and lashed across the bare buttocks with a rattan rod.

The punishment drew international attention in 1994 when American teenager Michael Fay was caned for spray-painting cars, despite objections from then-U.S. President Bill Clinton.

I'm glad they recognize her as a woman and sparred her from the punishment of a caning ,but selling drugs isn't the best way to make money or live your life. the thought of death for selling drugs,thats pretty crazy and thats why im glad to live in the U.S.

I agree. She was lucky enough she wasnt sentenced to get the death penalty. They hang people from drug and other crimes related cases in Singapore.

SINGAPORE: The Execution of Flor Contemplacion - A Day of Shame for Singapore

March 17, 1995 will be remembered as a day of shame for Singapore. Flor Contemplacion, a 42-year-old mother of four children was hanged on this day, while huge protests mounted in the Philippines and outside, demanding a review of the verdict against her on the basis of new evidence pointing to a frame-up. A witness also came forward stating that Flor Contemplacion was tortured in prison to force a confession. At the time of her execution, the world had reasons to doubt whether she was in fact guilty of the charges of double murder, of which she was charged. Any country which has a viable legal system would not have allowed such a hanging before all the new evidence was examined fairly and impartially. (Just a few weeks back, Pakistan courts acquitted two persons convicted under Blasphemy Law, showing that their legal system was well equipped to deal with a rather complicated situation.) There was no justification for the indecent hurry, with which this hanging has been carried out.

The architect of modern Singapore, Lee Kuan Yew had repeatedly claimed that Asian values on which the Singapore State is based are superior to a Western concept of human rights. The case of Flor Contemplacion exposed the falseness of this claim. Her execution is a barbaric act, done under in daylight.

However, this act is no surprise to any observer of Singapore’s political and legal system. The arrest and prolonged detention of over 21 Singaporeans under the charge of attempting to overthrow the government is well known. There was no evidence of any sort against them. They were all released later without charges. However, the government made no apology, paid no compensation.

It is also a day of shame for the government of the Philippines which acted slowly and even then indecisively. Perhaps it considered Singapore investments were more important than the life of a domestic helper. One witness had claimed that she informed the Philippine Embassy in Singapore quite early about what she knew of the attempts to frame Flor Contemplacion.

It is also a matter of concern for human rights organizations as to why this case did not come to their attention much earlier.

We call upon all concerned persons for a thorough investigation into these matters.

We express our deepest sorrow and sympathies to the husband and children of Flor Contemplacion.

What kind of justice system is that not only is that wrong,but inhumane. I feel sorry for Flor Contemplacion and her family the thought of that whole case makes my skin crawl. First She was framed,tourture and hanged talk about injustice to the extreme.

Yeah..The recent one was that Australian guy (Nguyen Tuong Van) whom was executed in 2005 who said was caught with 400g (14 ounces) of heroin at Singapore airport while travelling from Cambodia to Australia.

I think its insane. Its not like he was caught selling them or anything. WTF?

Yeah Singapore has tough drug laws,and everybody knows about them.If you are stupid enough to smuggle drugs into Singapore than you are playing Russian Roulette,its quite simple...just say "No" in SG and you wont have any problems.

SG isnt the only place where this law is in effect.The first thing you see when you step off the plane in Taipei is a big sign that say drug possesion is punishable by death.....

Singapore is a lovely place,just dont bring drugs...quite simple.

That is true. And that makes alot of sense..Dont carry any drugs when travelling to foreign countries you dont know what the laws are. 8)

Although back when Sadam ruled in Irag he pretty much did the same as what they are presently doing in Singapore. In Iraq, they behead people who commit crimes..some of which were to go againts Hussein's political views. They get abducted, beaten to death, electricuted, sodomized and beheaded (goes too for their families). So to behead or to hang people is I think a bit cruel a punishment nevertheless. :wink: Its unconstitutionally inhumane. Even animals got the right to live. Hence there are animal rights activist.

Besides, did you read about the young guy whom they hang in Singapore? Would anyone who gets caught with drugs possession in the US get hanged? No. They dont. They go to jail pay fines and do time. Doing something as silly and wrong as doing drugs and get the death penalty doesnt teach anyone any lesson. A wrong doing cannot be corrected by another wrong. Bottomline is Killing people is wrong.
