View Full Version : Is it legal for a director to affect a member's billing account through the biller?

HI everyone! I just got banned from Kink.com because Tomcat dislikes criticism. This person has affected my billing account with the billing company. Tomcat or some he knows made changes to my billing account without my permission.

I know some billing companies will block consumers because of refunds. A few years ago someone stole my credit card information and used it to buy porn. My bank took care of the problem. However, the billing company still blocked me regardless they knew the card was stolen.

Is it legal for a director to have my billing information?

Tomcat doesnt have access to your account but as a Director he can supply management of your info and have you banned and that is their perogative. I am surprised that other sites havent done it yet because you do it on EVERY forum.

Also I read on a forum where you told members to complain to ccbill and they could get their money back because "you have done it other times", I am suspicious of such a comment. However I do know that ccbill monitors how many times a "member" ask for a refund or chargeback. Eventually if you cotinue getting banned or get a refund from ccbill your card and info will be blocked from the main biller.

It is a companies total RIGHT to decide whom they want as members!

You're not posting the COMPLETE story. I told members on another forum IF a company has FALSELY advertised or other legal problems then companies like CCBill will contact the webmaster and will give a refund. Billing companies only ban people when they deny the charges. However, in some cases the credit card is actually stolen but the billing company may block the card just for protection.

A few months ago I joined a site. However, I could not log in. The representative from the billing support could not log into the site. CCBill contacted the webmaster, and the webmaster ignored them. CCBill gave me a refund.

Not all refunds are illegal. More than half of all refunds are legal because of webmaster problems.

Is it wrong to criticize a director or a porn site? No, if the criticism is done in a mature manner. I have never posted "this sucks", "get a new job", "wow who made this". I have always made statements with support facts about scenes that I like and dislike. I'm not going to post "awesome scene!" I'm going to say this scene is good because of the pornstars did a good performance and I liked it when he fucked her really hard.

If no one criticizes a director nor a porn site then how are companies going to know what members dislike and like?

I have praised and gave negative criticism to SMC and Grooby. However, neither company has ever blocked me. I have never said Grooby SUCKS! I think don't that at all about the overall product. I have always gave both companies reasons why I dislike and like their content.

I posted criticism on your IR site forum. I said I felt like the site has gone downhill because of the lack of American women. There was a time when IR T-Girl didn't have an American update for a long time. I was very disappointed and stated my feelings.

Irony. Yes, they are the billing company. However, they told me that Kink or its director can refund accounts for ANY reason.

Epoch did not block me because of the foolishness that has taken place. I've been speaking to their support and they really helped me.

Franklin seems to walk the fine line between criticism and opinion, often blending the two into a unique mixture that is bitter to any palette. What I find to be highly reflective of Franklin's approach to all things is that he firsts opens a thread questioning the 'legality' of a measure taken as a response to his big mouth. Does he stop to think that perhaps what he posted could be hurtful or inflammatory? No he only thinks about himself, I say take a page out of the kink.com playbook with reference to Mr. Franklin.

Wendy's references to questionable ccbill-related postings on other forums only further supports your mean-spirited and deceitful character.

I'm not mean nor deceitful.

I have never said anything hurtful when giving criticism. I have made comments such as "I dislike this scene because the two performers didn't have any chemistry. The scene was long and boring because neither pornstar had any energy". That's not hurtful nor rude. I have also made comments such as "I'm not into Girl on T-Girl porn. It doesn't do anything for me". Again a comment that is not rude.

Read my comments at TSseduction. None of them are rude nor hurtful.

Criticism is an opinion.

Wow! people really don't know anything about porn and billing companies. Billing Companies will give refunds without blocking people IF the porn site's login page is broken, missing content, false advertisement, etc. CCBill always contact the webmaster to fix the problem. If the webmaster ignores them in a certain amount of days then the consumer will get a refund without being banned.

I think ALL companies would do justice if they did some research and seen how many times you have been credit or a refund...I think alot would be shocked as you have it down to an art form and now how to work the system.

Anyhow I am ALL open for critique about my websites but Franklin you do it on EVERY FORUM and dont stop its beyond critique but borderline nonsense.

FYI: It turned out the scene in question was NOT an old scene and in fact a new scene and you posted this before finding out the truth....FYI CCbill would have NOT emailed the webmaster asking about this type of situation and probably would grant a refund....So YOU supplied fire to a situation that wasnt even a situation...ITS TACTICS LIKE THIS THAT MAKE PEOPLE CRINGE WHEN YOU POST>

Wendy Williams. I just POSTED that CCBill contacts the webmasters if the member cannot log in. I also stated that was my situation for a site.

I have never stolen from a porn company. I am very offended by your statements. I have always paid for my porn. I never ask for refunds. I always inform the biller that I don't have access to a site that I paid for, they make the decision to give me a refund if the webmaster does not fix the problem.

I understand how the system works because I have paid for porn for 5 years. Out of the five years I have only received one refund because someone stole my credit card information.

You can ask Seanchi. I am sure he can look up my information. I have NEVER received one refund from Grooby. I have always paid for my porn. SMC has never given me a refund because I pay for my porn. I don't steal from people.

I have not stated anything that is borderline nonsense when speaking about a scene.

I admit that it was a mistake. However, you also did not state the complete story. Many members thought the scene wasn't new. Sammy explained to us that the scene was new. I also told him and Strokers staff that I was sorry for my statement. I also explained to them why members thought it was an old scene because of the very bad video quality. Strokers was also to blame for the situation. As I said the video quality was very bad compared to their other new content.

Im glad you are not a fan of me as I would not want your business. I think sometimes you have good intentions but overall not worth the hassle.

You're right. Strokers aren't to blame for what happen. Regardless of how the video quality was, they provided a new scene.

I made poor judgement on my part. My response was an overreaction. I made the post because CCBill helped me in the past with webmasters whose sites had broken login pages.

Franklin....you're not a particularly offensive sorta guy....I don't mind your posts, but there's another thread floating around that asks the question ..."Is Porn an Addiction or a Compulsion" ....I highly recommend it for you. It might help....You seem singularly focused on one topic. Maybe I'll take you out and get you laid....it will get you out from behind that computer, and you just might like it !
