We Don’t Hire Your Kind: The Zikerria Bellamy

http://www.transgenderlegal.org/headline_show.php?id=189

On July 10, 2009, 17-year-old Zikerria Bellamy (http://www.hungangels.com/media/uploads/doc_218.jpg) applied online for a position as a Shift Manager or Crew Leader at a McDonald’s restaurant in Orlando, Florida. On July 28, after managers at McDonald’s learned that Zikerria is transgender, she received the following voicemail message from one of the managers:

Zikerria never received the job interview she sought. McDonald's refused to hire her.

Zikerria’s story is all too common. Transgender people face tremendous discrimination in the workplace. According to a recent survey (http://www.hungangels.com/media/uploads/doc_217.pdf) by the National Gay and Lesbian Task Force and the National Center for Transgender Equality, 47% of transgender people report being fired, or denied a job or promotion, just because of who they are.
Few protections exist for transgender people who experience employment discrimination. In 38 states (http://www.hungangels.com/media/uploads/doc_215.pdf), there is no law protecting transgender people from being fired because of who they are. Federal law similarly offers no job protection for transgender people.
In Florida, while no law explicitly addresses discrimination based on gender identity, administrative agencies in Florida have ruled that transgender people are protected by the Florida Human Rights Act’s prohibitions on sex and disability discrimination. The Competitive Workforce Bill (http://www.myfloridahouse.gov/Sections/Documents/loaddoc.aspx?FileName=_h0391__.docx&DocumentType=Bill&BillNumber=0391&Session=2010), which would add gender identity and sexual orientation to the Florida Civil Rights Act, was introduced in the Florida legislature on November 20.
At the federal level, the Employment Non-Discrimination Act (ENDA) (S.1584 (http://thomas.loc.gov/cgi-bin/bdquery/z?d111:S1584:)) would address discrimination in the workplace by making it illegal to fire, refuse to hire, or refuse to promote an employee based on the person’s gender identity or sexual orientation at companies with fifteen or more employees. The legislation was introduced in the United States Senate on August 5, 2009. On November 5, the Senate Health, Education, Labor, and Pensions Committee held the Senate’s first hearing on the latest version of ENDA. A version of ENDA was also introduced in the United States House of Representatives on June 24, 2009. The House Education and Labor Committee held a hearing on the measure on September 23. Little has happened since (http://www.transgenderlegal.org/headline_show.php?id=197).

According to a 2007 survey (http://www.hrc.org/issues/transgender/9607.htm), 72 percent of Americans agree that "fairness is a basic American value and employment decisions should be based solely on qualifications and job performance, including for transgender people." In a 2002 poll, 61 percent of those polled said that we need laws to protect transgender people from discrimination. President Obama supports the Employment Non-Discrimination Act and has stated his belief that anti-discrimination employment laws should be expanded to include sexual orientation and gender identity.

I was denied work at Wal-Mart because I am a transsexual. I had applied for a security (loss prevention) position but they threw out my application when they saw my name. My friend worked there and the manager knew who I was from her and that I was applying and she knew I am transgender. The online app printed fresh off the machine and the manager chucked it. My friend is a witness to that. The manager said they "don't hire trannies". Later on several gays and lesbians were fired from that Wal-Mart along with my friend who was a transsexual as well. A second transwoman was hired "by accident". They didn't know she was trans and when the manager found out she was fired. New York has no protections for employment of LGBT.

yep happened to me, thankfully i never had mean calls like this, but i applied at a zaxbys one time when i was 18 i asked the manager if they were hiring first and she told me they were so i got a paper applicaation and filled it out in the restaurant and gave it back to her right there and she told me she would look at it and she would be right back i saw her grab a cashier girl and pull her into her office and i could hear them laughing and stuff, then she return 15 minutes later and tells me they "are not hiring at this time, sorry" and return my application to me (which wtf am i going to do with?! seriously?)
anyways.. just my rant on the topic.. too bad this kind of thing happens waaaaay too often to more girls that i know than i can count.

What if it were a woman who was living their live as a man...would they be as likely to be rejected/fired or do most think there is more prejudice toward male to female transgender/transsexuals?

For me personally, I stopped eating at fast-food places over 5 years ago simply because I don't want to put that garbage into my body. I think everyone should respect his or her own self enough to not eat that crap too, but that is a different story.

I don't think of America's best and brightest people when I think of the sub-human, mouth-breathers that usually work at at those rat-infested, shit-holes. Despite all my rude candor, my point is to say that I am deeply offended to hear anyone suggest that someone is not qualified to work at Burger King because they have merged two genders into one body. How fucking retarded do you have to be to believe that?

It's both funny and sad to me that on every website I visit, it doesn't matter if it's a site for music, or politics, or sports, whatever...everything devolves into a race-war and/or a battle over orientation. People are so stupid these days that I wouldn't be surprised if there is website devoted entirely to people taking pictures over their shit floating in toilets. The saddest part is not just that such a site may exist; the saddest part is that the people that would be there right now would be engaging in one race-based battle after another with tons of homophobia thrown in too.

I bet it goes something like this;

"Country Boy72" types: Yeah...just crapped a 5lber. Damn thing stinks like ni99er too.

"Tupac's Glock" responds: Keep talkin dat trash lilly azz white craka. Yall pink folk be boring wit yo shitz, ya never poop anything creative unless ya be copying uz! Word!

"Metro Paulie" types: I am so proud of my latest turd, I think it has a nice arch that gives it a modern look.

"Steelers Fan4life" responds: I swear you are the biggest fag on this website Paulie. That turd is so light brown and shiny I can see the vaseline leftover from your boyfriend last night! Fag! Fag! Fag!

...and on and on it will continue to go.

Too many people are dumb and this voice-mail is a perfect example. Make no mistake, the end of the world wont have anything to do with some arbitrary calender date or some preachers prediction of the apocalypse. Retards making retards will be the death of the human race.

Fee fi fo fum :fuckin: we aint be using no con-dumbs!

lol. I don't think my 2nd post reads exactly as I meant it to. I was just trying to convey the frustration of people pretending to be deaf when somebody tries to yell time-out on the fighting. That is the world we live in.

It's like...when we were in high school and people would see two individuals arguing everyone started yelling: FIGHT! FIGHT! FIGHT!

The majority of the world is still doing that shit about everything. It get's old...for me. Great for everybody else of course.

how does this girl, and the girl that mentioned that she didnt get hired at walmart, not sue?!?!?!?! if you can prove that you didnt get hired specifically because you are TS then you should be HAPPY!!!! because any lawyer worth his weight in shit could win a big settlement. and mcdonalds and walmart are probably the 2 best companies in the world to sue due to how much money they have and how probable it would for them to settle so it doesnt make the news. so if i was ts or gay i would say, "discriminate against me all you want and ill cry after I count my money"

What a wonderful idea. On what grounds would you sue them then, discrimination against gender orientation maybe? Sadly in 38 states there are no such laws that prevent this kind of discrimination. In other words the girls you are referring to have no legal grounds for a lawsuit because neither Maryland nor Florida is one of the 12 states that have banned discrimination against transgender people. This is especially relevant because the Maryland legislature recently declined to pass anti transgender discrimination laws that while not perfect might have helped this girl in her job quest. Unfortunately those same laws would not have helped Chrissy Polis because they specifically excluded public accommodation protection for transgenders and because of that exclusion were actually opposed by some elements in the TG community. Currently Nevada is considering several bills that will ban discrimination against transgenders as well which is especially pertinent since a transgender woman was recently thrown out of a hotel in Vegas simply for using a completely empty ladies restroom at 4AM in the morning. If you want to help the TG community first educate yourself against the legal challenges we face, this help us work towards changing the law so that we have a fighting chance against hatred, hypocrisy, intolerance and discrimination.

UNDUE BURDEN

Undue burden standard

From Wikipedia, the free encyclopedia

Jump to: navigation (http://www.hungangels.com/vboard/#mw-head), search (http://www.hungangels.com/vboard/#p-search)
The undue burden standard is a constitutional test fashioned by the Supreme Court of the United States (http://www.hungangels.com/wiki/Supreme_Court_of_the_United_States). The test, first developed in the late 19th century, is widely used in American constitutional law.[1] (http://www.hungangels.com/vboard/#cite_note-0)
One use of the standard was in Morgan v. Commonwealth of Virginia (http://www.hungangels.com/w/index.php?title=Morgan_v._Commonwealth_of_Virginia&action=edit&redlink=1), 328 U.S. 373 (http://www.hungangels.com/wiki/Case_citation) (1946). In a 7-to-1 ruling, Associate Justice (http://www.hungangels.com/wiki/Associate_Justice_of_the_Supreme_Court_of_the_Unit ed_States) Stanley Forman Reed (http://www.hungangels.com/wiki/Stanley_Forman_Reed) fashioned an "undue burden" test to decide the constitutionality of a Virginia (http://www.hungangels.com/wiki/Virginia) law requiring separate but equal (http://www.hungangels.com/wiki/Separate_but_equal) racial segregation (http://www.hungangels.com/wiki/Racial_segregation) in public transportation. "There is a recognized abstract principle, however, that may be taken as a postulate for testing whether particular state legislation in the absence of action by Congress is beyond state power. This is that the state legislation is invalid if it unduly burdens that commerce in matters where uniformity is necessary—necessary in the constitutional sense of useful in accomplishing a permitted purpose."[2] (http://www.hungangels.com/vboard/#cite_note-1)
More recently, the standard has been used in cases involving state restrictions on a woman's access to abortion (http://www.hungangels.com/wiki/Abortion). The standard was applied by Associate Justice Sandra Day O'Connor (http://www.hungangels.com/wiki/Sandra_Day_O%27Connor) in her dissent in City of Akron v. Akron Center for Reproductive Health (http://www.hungangels.com/wiki/City_of_Akron_v._Akron_Center_for_Reproductive_Hea lth), 462 US 416 (http://www.hungangels.com/wiki/Case_citation) (1983). O'Connor utilized the test as an alternative to the strict scrutiny (http://www.hungangels.com/wiki/Strict_scrutiny) test applied in Roe v. Wade (http://www.hungangels.com/wiki/Roe_v._Wade), 410 U.S. 113 (http://www.hungangels.com/wiki/Case_citation) (1973). The test was later used by a plurality opinion[3] (http://www.hungangels.com/vboard/#cite_note-2) in Planned Parenthood v. Casey (http://www.hungangels.com/wiki/Planned_Parenthood_v._Casey), 505 U.S. 833 (http://www.hungangels.com/wiki/Case_citation) (1992), to uphold state regulations on abortion.[4] (http://www.hungangels.com/vboard/#cite_note-3)[5] (http://www.hungangels.com/vboard/#cite_note-4)[6] (http://www.hungangels.com/vboard/#cite_note-5) In City of Akron, O'Connor stated: "If the particular regulation does not 'unduly burden' the fundamental right, then our evaluation of that regulation is limited to our determination that the regulation rationally relates to a legitimate state purpose."[7] (http://www.hungangels.com/vboard/#cite_note-6) Justice John Paul Stevens (http://www.hungangels.com/wiki/John_Paul_Stevens) in his partial concurrence, partial dissent to Casey further defined undue burden by saying, "[a] burden may be 'undue' either because [it] is too severe or because it lacks a legitimate, rational justification."[8] (http://www.hungangels.com/vboard/#cite_note-7)
The undue burden test has been used to judge the constitutionality of tax laws,[9] (http://www.hungangels.com/vboard/#cite_note-8) consumer product liability laws,[10] (http://www.hungangels.com/vboard/#cite_note-9) affirmative action,[11] (http://www.hungangels.com/vboard/#cite_note-10) voter registration laws[12] (http://www.hungangels.com/vboard/#cite_note-11) and even anti-spam (http://www.hungangels.com/wiki/Spam_(electronic)) laws.[ (http://www.hungangels.com/vboard/#cite_note-12)

do those states recognize transgender people as transgnder? or are these people legally women or legally men. Im saying, is this TS legally a woman or legally a man...because this TS has to be either or. and if the TS is legally a man (which she probably is because if a state hasnt passed transgender equality laws then they probably wouldnt let a man legally become a woman) then she could sue for discrimination of sexual orientation then she would EASILY win...the manager actually said "we dont hire faggots"
it is actually illegal for employers to discriminate for any reason.
