Hi I heard four a while that sylvia boots was in jail four murder..
and got 45 years in prison. I also heard that she was Defense her self and never have control over the gun. Someone knows more of this case?

O.K., here goes. Sylvia was being harassed for many months prior to the shooting by another transsexual. At one point, she was beaten by this other girl's friends and at another instant, this other girl's boyfriend had a triste with Sylvia. When the triste was found out all hell broke loose. The guy showed up at Sylvia's place and stole her car. She reported all this to the police and was told, off the record, by a cop to get a gun to protect herself. The night of the murder, Sylvia was at a club where she encountered the other t-girl in a restroom. They began to go at it and were ejected by the management. Sylvia and a friend found themselves in the parking lot with the other t-girl and 2 or 3 of her friends. The hostility continued, and Sylvia attempted to get in her car and get away. Someone in the other party was blocking her in, and she freaked, thinking back to the incident where several of these girls had attacked her before. She grabbed her gun from the car and brandished it to scare the others away so she could leave. One of the other girls went for her, they scuffled, and the gun went off. The bullet went in one lung, nicked a coronary artery, and stopped in the other lung. In 30 seconds the girl was dead. As far as the court case went, Sylvia had a lawyer(court appointed?). The case lasted one week. She was convicted of 2nd degree murder with special circumstances. The case was held in Beverly Hills instead of West Hoolywood and th DA overcharged, it should have been manslaughter. On top of that, the judge cited the wrong section of the sentencing code, essentially throwing the book at her. In light of all the prior mitigating circumstances i.e., the beating and car theft, as well as the hostile environment partially created by the victim and the fact that the gun went off in a scuffle, she should have been charged with manslaughter, at most. The special circumstance charge had to do with the fact that an automobile was involved, basically a law written for drive by shootings. There was quite a bit of injustice involved in the legal process. She is appealing, stay tuned, hopefully she'll have a good appeals lawyer.

I believe the girl that was killed was actually one of Sylvia's friends that was trying to break it up. Sylvia wasn't trying to shoot her. The girl that was the main instigator walked away scott free.

Normally, I would agree with a strong sentence, but I truly believe in this case, it was overcharged. This was clearly not a "black & white, open & shut" case. There were a lot of other factors involved. The law is always very tricky when it comes to crossing the line between self defence and murder.

A lot of people (and the legal system) dropped the ball long before that night in the parking lot.
