View Full Version : Public Notice regarding the unauthorized use of my Intellectual Property

For quite a while I have let a lot of people slide on what should have been common courtesy in relation to use of my work. But lately, things have really gotten out of hand to the point where I am forced to lay down the law and begin taking the appropriate actions against those who are outright stealing from me in addition to forcing others to "do the right thing" when it comes to using my work. The straw that broke the camel's back was when girl took my pics, used them for commercial purposes on her pay site, and to top it off had the balls to PUT HER OWN WATERMARK ON MY PHOTOS - in other words claiming them as her own work. This is beyond unacceptable.

As a result, I am forced to abandon the concept of "letting people do the right thing" and set forth the rules which I always told girls about using my work, but it seems almost all have now forgotten.

I) You MUST get my permission BEFORE using any of my work for Commercial Purposes: in other words, no using my work for Commercial websites or advertising on such sites as Eros, Backpage, Craigslist or any other commercial purpose.

The major exception to this is the use of pictures by the various party promoters (including, but not limited to Sunny, Allanah, Dina, Sandy Michelle, Asian Michelle) of pictures taken AT THEIR EVENTS for the purpose of PROMOTING THEIR EVENTS. (However, it would be appropriate to at least credit me when you use them like every other photographer seems to receive the courtesy of).

II) If you want to use my photos OF YOURSELF on social networking or similar sites (such as Myspace, Facebook, etc.) you do not need to ask permission first PROVIDED I RECEIVE CREDIT FOR THE PHOTO in one way or another.

III) If you want to use my photos OF SOMEONE OTHER THAN YOURSELF, you always need to receive my permission in advance.

IV) Obviously, any specific written agreements with any individual, corporation or other entity take precedence over any of the above.

NB to the Peanut Gallery: before you go using terms like Copyright, Fair Use, Model Release, Public Domain or other technical terms, please go check your facts because I'm not going to debate idiots who want to spew bullshit about things they have no clue about on this site.

I am sorry it had to come to this. I never wanted to put limits on reasonable uses of my work, but unfortunately people don't seem to get what "reasonable" is.

No, because they are by and large specifically intended NOT to be used for commercial purposes, and mostly for sites like Facebook, Myspace, etc. (for the girls use) and I personally find watermarked photos on the social networking sites to be very off-putting. Same goes for the main purpose of most of the photos, which is to aid the party promoters.

But also, either the watermark has to be way too intrusive, or it is all too easily cut out. For example, take the most recent Shemale-Yum photos I have seen: I could crop out the logo in about 3 seconds without affecting the pics much at all. In fact, lately I have seen a TON of pics from various sources which I KNOW were originally watermarked used on Backpage, Facebook, etc. with the watermark cropped out.

Not only look at the second 2 pics in the ad, but look at the site logo she is using - could watermarking have done anything on that?

We all know it can be cut out but at least if the originals are circulating ONLY with your mark on them then people should know that they are genuine and you get your credit. If somebody does infringe by cutting off your mark, then it gives you more basis to go after them for altering it on purpose.

I can tell you right now, if you take my picture in public that I will use it any ways I please. So better put a watermark on it because its going on the candid section of my site if I want to use it.

As you'll note, for most of the items I'm not even asking for money unless the work is being used commercially (even though under the law i am entitled to do so). But I see NO excuse to use my work commercially without even asking for permission to do so.

But Jericho, as an example, how would you feel if you put up a photo on Facebook and linked to the subject. The subject removes the link (which would be fine if they did not like the pic), but then copies the pic and puts it up on her own page, giving no credit, as if it were her photo?

Also I have a question. So for an adult performer that does a photoset for a website. Is it unheard of or unusual for the model to receive a set of pics to use on her main site. Not for Sale but for promotional purposes.

It's not "unheard of", but most sites won't do it. But certainly the owner of the content would not expect that it would be used with no credit and without asking permission first. Also, even when it's done, I don't think they would give the model a "photo set" from one shoot as it is being used on the site; perhaps a pic or three. Maybe someone from Grooby will chime in with what they do.

Let me ask you a question: how would you feel if you saw an ad for Naked.com (another cam site) and the pics on your cammodels page were used in their ad?

I always tell models I shoot that they can use a few of the pics for their own promotional purposes, as long as they keep the watermark on them. It promotes the model and also promotes the site that the rest of the pics can be found on. And as long as the model is not reselling the pics or charging to view them, I don't see any problem with it and in fact, encourage it. I want any model I work with to be as proud of the work as I am.

If I take candid pictures of a model without them agreeing to be photographed, and post them on the internet, I have no expectations on retaining sole use of the images or even being credited for taking them.
