Depends on the state... Some states go by the sex on your ID and some on your Birth certificate.

California goes by your ID. You don't need SRS to change your gender on your ID. So like me for instance... my ID says F. So I can only get married to a man in CA.

Once you have surgery you can have your birth record amended and impounded so that they will never be opened again.

My birth certificate, passport, social security and DL say female
