Hey all,

ok this may sound a weird post but jsut wanted to know if anyone is familiar with copyright law regarding music/covers ?

Basically I am shooting some content/DVD and I am doing the music as well, but the theme of the dvd is shall we say abit comic hero based and the original film had a soundtrack done by Queen...

Now i want to basically take one of the origanl songs and replay it myself at a studio and change the sound alot but retain abit of the feel if you follow me... Is this just asking for a fuck off legal whooping? Of if i change it enough ..

Thoughts/ advice / ?

I'm not an expert..but there have been lawsuits in the past of "similar" sounds of other bands. Suppose if it's not a straight rip of Bohemian Rhapsody you should be ok. :)

Check it out on the copyright.com website...

It is a complicated issue, the short of it is that the song is changed enough to be a true parody. Most parody cases have been declared "fair use", and therefore allowed.

Link to a pretty good article.. http://www.publaw.com/parody.html

Depends on your budget.

You can always offer to negotiate a deal with the original performers, Queen, or if they won't deal with you, fuck 'em and pay the mechanical rate.

You can get away with all kinds of things when it's just amateur stuff & there's no money involved. But if this is a commercial venture, get the proper permissions. Even if there's upfront fees involved, it's cheaper than lawyers if it ever turns a dime. Look up ASCAP. Parody is protected in political opinion, but commercial use opens a whole other can of worms.

if you cover it, and replay everything (good luck by the way), without doing any sampling, you should be fine. whomever has the publishing credits will likely get mechanical royalties should your project get a proper release.

well its bascilly just i want to rip the song flash gordon, and use it for my porn DVD intros and soundtrack :) nothing major :)

I have redone all the lyrics, have worked out some different notation so it has a different sound but still retain a feel of it :)
