Where to start........ ok, first with the disclaimers: I am friends with Sunny, Allanah, Dina and others of the party promoters. Second, I am one of the regular photographers at the events.

I may be wrong on this but I believe Sunny's general policy is the she will blur the faces of any guys in photos taken at her parties, and I believe Allanah's policy is that she will attempt to keep guys out of the photos if possible, but if not, she's open that guys who come to her parties may end up in photos so they have been given "due warning". (I believe this contradicts a prior post which claimed that no guys appeared in Allanah's party photos, but I'm also pretty sure Allanah has explained her decision and reasoning more than once on this subject, and they are her parties, and she is not secretive about it).

In this particular case, I believe what happened is that Jade brought along a friend who took photos, which Sunny had no control over, and those are the photos which got posted.

Now, as far as the law goes, in terms of pictures like this, there is no requirement to get a release to use these pictures. If that was the case, the entire paparazzi would be out of business tomorrow. I don't have access to the inside of that site; if the photos also appear in the "pay section" they may be deemed to be being "sold", in which case a model release under certain circumstances, might be necessary, but I doubt anyone is ever going to lose a case over it. Part of this has to do with the fact that while this might be considered a "private event" in some people's eyes, in general it would still be considered "public" in terms of the appearance.

Getting on to my personal feelings on the matter: I don't think guys should appear in any recognizable way in any photos unless they know and consent to it. I feel the same way for the girls, many of whom do not want their pics taken either. I don't think that simply blurring the faces of guys is sufficient in terms of meeting this burden, either. I make my best attempts not to get guys in the photos to begin with, but some guys insist on either walking in between me and the subject while I'm clearly shooting, and some other guys insist on positioning themselves in places where the know they will be in the shots and it is impossible to keep them out - like guys who park themselves behind or adjacent to the stage where girls are dancing. I will also pull up from a shot of a girl on stage if I see a guy approaching the stage to tip since I think it's more important for the girls to make their stage tips than for a photographer to get his shot. Taking a shot doesn't happen in a millisecond, however, so sometimes if I've already started the shot it's not physically possible to stop and keep them out of the shot. But I do also admit that since I know I will be editing/cropping shots before posting them, I will take shots with guys in the frame with the intent of removing them before publishing.

And when I say "removing", I don't mean blurring faces. In the following posts I will give some examples of what I think are proper examples of what should be done. I appologize in advance to the guys whose faces are blurred in the following examples, I just don't know how else to illustrate my point.

Now, some of you may say "But slinky, I've seen guys in your pics". These generally fall into a few special categories: 1) If the promoter of the even has put everyone on notice that the event is "open for photography" and posts themselves photos with "crowd shots", I feel that's sufficient notice; 2) If the guy or girl in question has specifically consented to the photo (pretty much whenever some girl pulls a guy over and asks me to take their photo, I make sure it's ok with him, and if he shows any reticence I will not take it); 3) Mistakes. yes, I'm human and I make them. I try not to, but sometimes I fuck up; 4) If the use of the photo is not for the web, but some other special purpose. I'll give a recent example: I made a video of party photos which was to be used to play AT THE PARTIES. I'm not sure anyone can tell me seeing a pic of a guy up on a wall who is seated directly below that pic is damaging to him.

I don't know what the big fuss over being photographed at a Sunny party. I've been to a few and checked out all dudes there. There was no one I recognized. I.e. media types and public officials who could be potentially blackmailed. Anonymous faces in the crowd all (myself included). I really like that "peg board" feature on Jade's "preview" page. Is that canned and readily available somewhere?
